How You Become a California Notary
California notary requirements are specific: you must be at least 18, live in California (or live in an adjoining state and have a California business address), complete a 6-hour state-approved course, pass the Secretary of State exam, submit Live Scan fingerprints and file a $15,000 surety bond and oath. The exam is 45 questions and you need 70% to pass; the exam fee is $40. Your commission then runs four years. Renewals require a shorter course plus the same exam.
What the Exam Covers
- Appointment and qualification — age, residency, the course, the bond, the oath, the exam
- Powers and limitations — acknowledgments, jurats, certified copies of powers of attorney, and what a notary may never do
- Identification and journal — the rules on satisfactory evidence, the required journal entries, and how long records must be kept and produced
- Fees and prohibited acts — the maximum fee per signature, and the acts that will end your commission
- The Signing Agent side — the loan documents you will see as an NSA, and how notary law applies to each
Where People Lose Points
Journal entries are the most common failure point: exactly what must be recorded, in what order, and what happens if a signer refuses a thumbprint. Identification comes second — the exam tests whether a document is acceptable evidence, not just whether it looks official. Third is the fee schedule and the prohibited-acts list, both of which are memorisation questions with no room for judgement. The exam is only 45 questions, so missing a handful of these is enough to fail.
How to Prepare
Work the questions in rounds and read the explanation every time, even when you get it right — the explanations are where the statute language lives. Aim for three consecutive rounds at 90% or better before you sit the real exam.
